A 37-year-old man was shot and killed by a Harris County Sheriff's Deputy during a struggle in an apartment complex on the east side of the county, HCSO officials say.

Deputy Michael Medina, an eight-year HCSO veteran, was responding to a disturbance call at a complex in the 13100 block of Woodforest Boulevard when he got into a physical altercation with Charles Roy.

HCSO's description of the incident:

The deputy was met at the door of the apartment by the suspect [Roy], who immediately began fighting with the deputy. During the struggle, the suspect and the deputy fell down the stairs. Deputy Medina deployed his Taser at the suspect to try and subdue him, but the Taser was ineffective. At some point during the struggle, the suspect managed to take the Taser from the deputy. Deputy Medina, fearing for his safety, discharged his weapon striking the suspect once.

Okay, so the deputy fires his Taser at the guy to no effect. Then the guy steals the Taser and all of a sudden the deputy is "fearing for his safety"?

The Harris County District Attorney's office will investigate the incident, as is standard.
