A Sharpstown High School math tutor faces two felony charges related to an alleged inappropriate relationship with a student, according to a Houston Independent School District press release.
Aldo Leiva was charged with sexual performance by a child and possession of child pornography, after the 51-year old instructor was allegedly caught having a sexual relationship with a 17-year old student.
According to the charging document, the 17-year old's mother found nude photos and explicit texts on the girl's phone, including a picture of the girl kissing an older man, who a truancy officer at HISD identified as Leiva before immediately informing HISD police.
Leiva initially denied to investigators that his relationship with the student was inappropriate, claiming he was only her "mentor/teacher/friend/listener." But the girl told police that they started "dating" last summer, when she was just 17, and that they were sexually active together, including trading nude photos on their phones. According to court records, police found evidence of "many sexual conversations and "sexual pictures" on the pair's phones.
Text messages also allegedly showed that Leiva liked superhero-themed role-play; Leiva allegedly referred to himself as "Batman" and called his penis "Robin," and police allege that one photo found on the girl's phone shows Leiva wearing a Batman mask. Leiva allegedly wrote to the girl "I want to poke you with my robin" in a text message exchange that police said occurred during when the girl was in class.
According to the complaint, Leiva induced the girl to send him naked pictures on multiple occasions while she was underage.
HISD said in a press release that the allegations against Leiva were first reported to the district in February, and they immediately notified police. The district said Leiva resigned when he was made aware of the allegations.
"HISD takes situations such as this very seriously, as the safety of students is always the district’s top priority," the district said in the release.
A warrant is out for Leiva's arrest, but he is not yet in police custody. He's about 5-foot-6 and 200 pounds. If you see him or know where he might be, you should call Crime Stoppers at (713)-222-TIPS (8477).
