Grand jury will decide if charges will be filed

Unidentified Male, Bayou Body Count No. 221

A 90-year-old man and neighborhood fixture shot and killed a man who was acting violently in his northeast side home, and the case will be referred to a grand jury.

Police say the elderly man "is known in the neighborhood for his generosity and people frequently will ask him for money."

He allowed the victim, whose identity was not released, into his house in the 6200 block of Antha late in the evening Tuesday.

Police say the victim "became agitated and grabbed the homeowner's gun off a shelf. He pointed the gun at the homeowner, threatened the homeowner and threatened to commit suicide. The homeowner eventually disarmed the male and demanded he leave. The male refused to do so, paced around the apartment and then attempted to attack the armed homeowner. The homeowner, fearing for his life, fired his weapon fatally striking the male."

The victim was declared dead at the scene.
